1. Introduction

Welcome to J3 Mobile Notary, a division of J3 Professional Solutions LLC. These Terms and Conditions ("Terms") constitute a legal agreement between you ("Customer," "Client," or "you") and J3 Mobile Notary ("we," "us," or "our"). By booking an appointment, accessing our website, or using our mobile or remote online notary services, you agree to comply with these Terms.

2. Services

J3 Mobile Notary provides professional Notary Public services, including:

Mobile Notarization: On-site notary services at your requested location.

Remote Online Notarization (RON): Digital signings via secure, state-approved video platforms.

Specialized Signings: Support for Power of Attorney, Hospital/Bedside signings, Real Estate closings, and Legacy Planning.

Legal Disclaimer: We are NOT attorneys licensed to practice law in New York or any other state. We are not allowed to draft legal documents, give advice on legal matters, or advise on the tax implications of your documents.

3. Appointment & Cancellation Policy

Identification: It is the Customer's responsibility to provide a valid, unexpired government-issued photo ID at the time of service. Failure to provide proper ID will result in a cancelled appointment and a forfeit of the travel/service fee.

Cancellations: Appointments cancelled with less than 1 hours' notice may be subject to a cancellation fee.

Travel Fees: Travel fees are earned upon the Notary's arrival at the location, regardless of whether the notarization is completed due to document errors, lack of ID, or signer refusal.

4. Remote Online Notarization (RON)

Clients opting for Online Notary services must have a device with a working camera/microphone and a stable internet connection. You consent to the recording of the video session as required by New York State law for the Notary’s digital journal.

5. Payment Terms

Fees: Service fees consist of the NYS statutory notary fee plus travel, convenience, or technology fees.

Payment: Payment is due at the time of booking or upon completion of service as agreed.

Refunds: Service fees are non-refundable once the notary act has been performed or the notary has arrived at the appointment location.

6. Acceptable Use & Compliance

You agree not to use our services for any fraudulent or illegal activity. You are responsible for ensuring your documents are complete (except for the signature) prior to the Notary’s arrival. The Notary reserves the right to refuse service if they suspect fraud, coercion, or if the signer lacks the capacity to understand the document.

7. Data Protection & Privacy

We respect your privacy. Our collection of data, including ID verification and video recordings for RON, is handled in accordance with our Privacy Policy and NYS Notary Law. We are HIPAA-compliant regarding the handling of sensitive medical-related documents.

8. Limitation of Liability

No Warranties: J3 Mobile Notary provides services on an "as-is" basis. We do not warrant that a notarized document will be accepted by your specific third-party recipient (e.g., a specific bank or foreign consulate).

Liability Cap: To the fullest extent permitted by law, our total liability for any claims arising from our services is limited to the total amount paid by the Customer for the specific appointment in question.

9. Dispute Resolution

Governing Law: These Terms are governed by the laws of the State of New York.

Arbitration: Any disputes arising under these Terms will be resolved through binding arbitration in Queens County, New York.
